Employment Law Lawyers are the modern day equivalent of medical tonic quacks.

First, the chances of any company losing a discrimination lawsuit are so remote, that any company in NYC can probably get away with lynching Blacks if they wanted to.

There reportedly are federal judges on the bench who have NEVER found for the plaintiffs in a racial discrimination lawsuit for the entire time that they have been federal judges. In other words, there are federal judges who have never ever seen evidence of racial discrimination in America.

This said, there is still this INDUSTRY of lawyers creating all of these bullshit employment law policies for companies supposedly to advise companies on how they can avoid employment/discrimination lawsuits. What I find funny is that most companies probably spend more money paying lawyers for advice on how to defend against racial discrimination lawsuits than they would ever pay if they actually lost a discrimination lawsuit.

HOWEVER, the fact of the matter is that, because of the employment law lawyers and because of how everyone knows the Courts work, it is in every company's interest (when you apply for a job and the company does not want to hire your) for that company to label you as not-qualified because it is protection against a possible lawsuit. In other words,

For Most Companies, it is not enough that they don't want to offer you a job, they feel the need to label you as unqualified - and therefore to hurt your chances of possibly getting any job - just to cover their asses in case you might think about suing them.

Almost all of the major investment banks, law firms and temp agencies have tests that they give applicants. And, it is now clear that if some of these companies don't like you, you are not going to pass their test.

Every company in New York City knows that no Judge is New York City is going to find you qualified if some company claims that you failed their test, no matter what the test is.

In practical terms, there are some companies like Simpson Thacher and Cadwalader whose testing procedures are KNOWN to be suspect.

For one thing, I and most of the temp agencies I know, have a detailed description of Simpson Thacher's test and Cadwalder's test. So, when a temp agency is training people on how to pass a test and then only Whites pass the test or only Black Women pass the test, it then becomes clear that something other than mere testing is going on.

WARNING

If you are new to temping and you don't want to be labled as NOT-QUALIFIED right out of the gate, it just may be in your interest to not test with the following companies when you don't have a track record with your agency:

Simpson Thacher
Cadawalder
Merrill Lynch/Proskauer Rose/Pitney Bowes.

A temp counselor recently told me something that I pretty much already knew. Specifically, this counselor said that if you test with Simspon Thacher, Cadwalader, and maybe Davis Polk, First Boston and Smith Barney, and they all claim that you failed their test, you are essentially FINISHED in NYC as far as any hopes you may have had of ever getting Word Processing Center work at a major law firm or investment bank.

Tests That Are Designed So That You Can't Pass Them

Most of these minority bitches Supervising Centers will just say that you failed their Word Processor test if they don't like the way you look. These stupid bitches are not smart enough to come up with anything more elaborate than this.

However, I went to this one temp agency, that I won't name again since they seem to be self-destructing on their all over-supply of tude, that had a number of elaborate tests that appeared to me to have been DESIGNED by someone so that no one could complete them in the time allowed.

The purpose of designing a test that no one can complete in the time allowed is so that the agency can then claim that you failed the test and hope that you will accept the fact that you were unable to complete the test as proof that you did indeed fail the test. In order words, the purpose of tests designed so that no one can complete them in the time allowed is to serve as a defense to an applicant claiming/suing the agency for discrimination.

I took this test at this one temp agency and I assume this temp counselor just took one look at me and concluded that I was not her type. In any event, it was clear that the woman did not read my resume, even though this agency had called me in to register.

After taking this agency's test, I sat in the lobby for a long time. At one point this Actress thing, that was also applying, actually positioned herself in front of me and made a point of showing me that she considered me of a lower class than she was. Well after some time, the temp counselor finally comes out and she tells me that I failed the math test. I then informed the woman that I have a degree in Electrical Engineering, which seemed to shake her up a bit.

The temp counselor next says that I could try taking the test again (I said no thanks). My position was that if my Degree in Engineering from Northwestern was not enough to show that I was qualified to do any math associated with a temp word processing assignment, what good would my taking their test again do?

The bottom line in NYC is that there are a lot of temp agencies in New York City and a lot of competition between temp agencies. The temp agencies that have time for bullshit are not going to survive long, they may get to waste a lot of people's time during their short little lives, but, thankfully, I think we can all count on them going out of business.

By far the biggest driver of TUDE in New York City were investment banks. Investment Banks, it seems, were just throwing money at stupid bitches fronting temp agencies for a number of years.

As I have said elsewhere, I am soo fucking glad that investment banking went in the toilet and that investment banks are actually looking at saving money (I've even heard of one IBank outsourcing word processing to India and this particular IBank is one of the few that is suppose to be making a lot of money right now).

If investment banks continue to be concerned about the cost of temps and Investments Banks can no longer (or choose to no longer) continue to allow idiots working for them to use temp agencies as their own private escort services, then temping in NYC may one day actually be about matching the best qualified candidate with the job.

Investment Banks made temping more like PROSTITUTION than like anything close to a legitimate staffing business.
